Gun Control
The 2nd Amendment to the US Constitution, says:
"A well regulated militia, being necessary to the security
of a free State, the right of the people to keep and bear arms,
shall not be infringed." There has been a fair amount of
litigation on exactly what this amendment means and doesn't mean.
A person is not necessarily part of the state militia, on the
other hand, historically, any man or woman who was a property
owner was deemed part of the informal state militia. There is
a fair amount litigation on this issue also. The Constitution
guarantees the right to bear arms, while simultaneously, the state
and federal governments have a right to regulate their use. For
example, felons may not lawfully own a gun. Machine guns are outlawed.
In Texas, one may apply for a license to carry a concealed weapon.
In order to do that, one must pass a background check and take
classes.
